Special Notice to Nortel Class Action Claimants
If you previously submitted a proof of claim in the securities class action litigations involving Nortel, which were brought in the United States District Court for the Southern District of New York, the Ontario Superior Court of Justice, the Superior Court of Quebec and the Supreme Court of British Columbia (the "Nortel Class Actions"), and that claim was approved, you do not need to submit another Proof of Claim Form to participate in the SEC Fair Fund. If you would like to verify the details of the claim approved in the Nortel Class Actions, please call 1 (888) 561-9182. You may also view the details of your claim on the "Online Claim Filing" page of this website.
However, if you engaged in, and wish to submit a claim for, additional transactions in Nortel common stock during the period of October 24, 2000 through the close of the markets on February 15, 2001 and/or April 24, 2003 through the close of the markets on April 27, 2004, for which a claim was not previously approved in the Nortel Class Actions, or did not submit a proof of claim that was approved in the Nortel Class Actions, you must submit a Proof of Claim Form and all required documentation with respect to those additional transactions. You may view your approved transactions and/or submit a claim for additional transactions on this website.
In addition, if you are a custodian, trustee or professional investing and claiming on behalf of more than one potentially eligible claimant in a pooled investment fund or entity, you will be required to certify that any distribution you receive will be allocated for the benefit of current or former investors and not for the benefit of management. You must comply with that certification requirement even for those previously approved stock transactions for which you are not required to submit another Proof of Claim Form. See Certification Regarding Pooled Investment Distributions.
If you have additional questions regarding the above, please call 1 (888) 561-9182 or send an email to Questions@nortelsecsettlement.com.
